- What to do next: steps to refinance after a late payment
The question: A reader had one late mortgage payment six months ago, and every lender so far has said to wait until a full year passes with no late payments. Is there any way to refinance after a late payment sooner?
The short answer: Often, yes. FHA, VA, USDA and Fannie Mae rules do not demand a full clean year after a single 30-day late payment, so a “wait a year” answer usually reflects the lender’s own policy. How long you wait depends on your loan type, how recent the late payment was, and whether it reached 60 days. If you are behind right now, however, most refinances have to wait until the loan is current again.
How long do you have to wait to refinance after a late payment?
The table shows each program’s lookback, using agency minimums as of November 2026. Lenders can add stricter rules.
| Loan type | Recent-payment rule | Source |
|---|---|---|
| FHA streamline | Every payment made within the month due for the 6 months before case number assignment, and no more than one 30-day late in the 6 months before that | HUD 4000.1, II.A.8.d.vi(C) |
| FHA rate-and-term (manual review) | The same 6 + 6 rule as the streamline | HUD 4000.1, II.A.8.d.vi(A) |
| FHA cash-out | Every payment made within the month due for the past 12 months, plus at least 6 payments on the current loan | HUD 4000.1, II.A.8.d.v(A) |
| VA IRRRL | No VA lookback while the loan is current, but the loan must be seasoned before VA guarantees the refinance | 38 U.S.C. 3709(c); VA Pamphlet 26-7, ch. 6 |
| Conventional (Fannie Mae) | No 60-day late in the 12 months before the credit report, and the loan must be current when you apply | Fannie Mae Selling Guide B3-5.3-03 and B3-5.3-09 |
| USDA streamline | No delinquency of more than 30 days in the 180 days before the lender submits the loan | USDA HB-1-3555, 6.2 D.2 |
For the reader’s case, the six-month mark decides how soon you can refinance after a late payment. Under the FHA streamline rule, a late payment in months seven through twelve before case number assignment counts as the one allowed 30-day late. The reader’s late payment is about six months old, so it is at the edge of that window. As a result, a few weeks may be enough. The USDA streamline works the same way. On a conventional loan, one 30-day late does not disqualify you by itself, because Fannie Mae’s hard stop is a 60-day late.
How does an FHA streamline late payment count?
FHA measures payments by the calendar month. HUD treats a payment as delinquent only when you do not pay it within the month it is due. So a payment due on the 1st and paid on the 20th may cost you a late fee, but FHA still counts it as made within the month due.
The FHA streamline also requires you to pay the installment due in the month before closing within that month. Because of that, keep every payment on time while the refinance is in process.
An FHA cash-out refinance is stricter. It requires every payment within the month due for the past 12 months, so a late payment six months ago blocks it for another six months. For the full rules, see our FHA streamline refinance guide or HUD Handbook 4000.1, section II.A.8.d.
Can you get a VA IRRRL with a late payment?
Yes, in many cases. VA’s Lender’s Handbook says an IRRRL generally needs no credit information or underwriting. VA’s rules set no lookback for a past late payment as long as the loan is current at closing.
The loan does need to be seasoned, though. Federal law bars VA from guaranteeing the refinance until the later of two dates: the date you have made six consecutive monthly payments, and 210 days after the first payment due date (38 U.S.C. 3709(c)). If you have had the loan for a year or more, you have usually met both.
Lenders can still add their own payment-history rules, such as no 30-day lates in the past 12 months. That kind of overlay may explain a VA IRRRL late payment denial. Our VA IRRRL guide covers the other program rules.
What do Fannie Mae and Freddie Mac allow on a conventional refinance?
Fannie Mae’s Selling Guide sets two firm rules. Your existing mortgage must be current on the application date, which means no more than 45 days since the last paid installment. Also, any 60-day or worse late reported in the 12 months before the credit report makes the loan ineligible.
A single 30-day late is not on that list. Instead, Desktop Underwriter (DU), Fannie Mae’s automated system, weighs it along with your credit score, debt-to-income ratio, equity and savings. So the same late payment may pass on one file and fail on another. Fannie Mae removed its 620 minimum credit score in DU on Nov. 16, 2025, but a recent late payment can still lower your score.
For a cash-out refinance, Fannie Mae also requires the first mortgage you pay off to be at least 12 months old. Freddie Mac’s Refi Possible program, for lower-income borrowers, is stricter: no 30-day late in the last six months and no more than one in 12 months. See our conventional refinance guide.
What about a USDA streamline refinance?
USDA looks back 180 days on both its streamlined and streamlined-assist refinances. The existing loan must have closed at least 180 days before the lender submits it to USDA. In addition, your payment history cannot show a delinquency of more than 30 days in those 180 days. The streamlined-assist option also requires the new payment to drop by at least $50 a month.
Why did lenders tell you to wait a year?
Lenders can set rules stricter than the agency minimums, called overlays. For example, a lender may require 12 months with no late payments on every loan type because of its own risk policy.
That is why shopping lenders still pays off. When you call, ask two questions. What is the agency rule for my loan type? Does your company add its own payment-history rule on top of it? If the answer is “12 months clean,” call the next lender.
How does a late payment show up on your credit report?
A late fee and a late mark on your credit report are separate events. Most mortgage notes include a grace period, and the servicer can charge a late fee once it passes, according to the CFPB. Once a payment is 30 days past due, the CFPB says, your servicer may report it to the credit bureaus as late.
Once reported, a late payment can stay on your credit report for up to seven years, the CFPB says. Still, its effect on your credit score fades as it ages and as you add on-time payments.
If the late payment came from a servicer error, such as a lost or misapplied payment, dispute it. Send your servicer a written notice of error. Under federal servicing rules, the servicer then cannot report negative information about that payment for 60 days. Also file a dispute with the credit bureaus using the CFPB’s dispute steps. Fannie Mae also lets a lender tell DU to ignore mortgage delinquency data that it confirms is wrong.
Can you refinance when behind on mortgage payments?
Generally, no. Most refinances need the loan to be current. Fannie Mae requires a current loan at application, and its guide bars bringing a past-due loan current right before closing just to get around that rule. Likewise, the FHA streamline needs every payment made within the month due for the six months before the case number.
The VA IRRRL is the exception. VA allows an IRRRL on a loan that is 30 or more days past due, but the lender must send it to VA for prior approval. Before it does, the lender must show that the cause of the delinquency is resolved and that you can make the new payment. Not every lender handles these, so ask first.
If you cannot refinance when behind on mortgage payments, these paths remain:
- Bring the loan current, then wait out the lookback for your loan type.
- Ask your servicer about loss mitigation, such as a repayment plan, forbearance or a loan modification. After forbearance ends, an FHA streamline needs three on-time payments and an FHA cash-out needs 12.
- Call a HUD-approved housing counselor. The help costs nothing, and the CFPB’s help for homeowners page links to one near you.
Act early, because the CFPB says the legal foreclosure process generally can start once you are 120 days behind. Later, our guide to a mortgage with bad credit covers options for a damaged score.
Is it worth it to refinance after a late payment right now?
Freddie Mac’s Primary Mortgage Market Survey put the average 30-year fixed rate at 7.18% on Nov. 5, 2026, up from 6.22% a year earlier. If your current rate is below today’s offers, a rate-and-term refinance would raise it. That rarely helps unless the goal is cash out or dropping mortgage insurance.
When a refinance would lower your rate, compare the savings with the cost. Say closing costs total $5,000 and the new loan cuts your principal and interest payment by $125 a month. You would break even after 40 months ($5,000 divided by $125). This example leaves out property taxes, homeowners insurance and mortgage insurance. FAQ
How long after a late payment can I refinance?
It ranges from no wait to 12 months. An FHA or USDA streamline needs the late payment to fall outside a six-month window, while an FHA cash-out needs a full year of on-time payments. A VA IRRRL sets no VA wait once the loan is current and seasoned.
Can I refinance an FHA loan if I missed payments in the past?
Yes, if the misses are old enough. The FHA streamline allows one 30-day late in months seven through twelve before case number assignment, as long as the last six months are clean. Misses older than 12 months do not count against the streamline.
Can you refinance if you are behind on payments?
Usually not until you catch up. The VA IRRRL is the main exception, since VA can approve one on a past-due loan through its prior approval process. Otherwise, talk with your servicer about a repayment plan or modification first.
Can I get a cash-out refinance with late payments?
It is harder. FHA requires 12 months of payments made within the month due before a cash-out refinance. Fannie Mae sets no separate 30-day rule for cash-out, although lenders may set tighter limits.
Who will refinance a mortgage with late payments?
Lenders that follow the agency minimums without extra overlays. Ask each lender for its own payment-history rule, and compare at least two or three before you accept a “wait a year” answer.
What to do next: steps to refinance after a late payment
Start with the facts, then shop:
- Get your payment history. Ask your servicer for 12 months of payment dates.
- Count the months from each late payment to your expected application date.
- Pick the right refinance. On an FHA, VA or USDA loan, a streamline or IRRRL usually has the shortest lookback.
- Ask lenders about overlays. Call two or three lenders and ask for the agency rule and their own rule.
- Explain the late payment. Write a short letter of explanation that gives the cause and shows it is resolved.
If you are still inside a lookback window, mark the date you clear it. Then keep every payment on time, and you can refinance after a late payment on the schedule your loan type allows.
